The short version:
- You get a fixed quote in writing, and that's what the job is.
- 50% deposit to start, 50% before the site goes live.
- Two rounds of changes are included.
- Once it's paid for, you own it. Your domain is always in your name.
- Monthly care is optional, and you can cancel with 30 days' notice.
These terms apply to every website project and monthly care plan from Human Web Co, ABN 46 298 119 036 ("I", "me"). Your written quote ("the quote") sits alongside them. If the quote and these terms ever disagree, the quote wins. Accepting a quote in writing (email is fine) or paying the deposit means you agree to these terms.
1. What's included
The job is what's listed in the quote: the pages by name, the features and extras, and any limits on them. Anything not listed is extra, and I'll quote it before I do it. Unless the quote says otherwise, the price doesn't include writing your content, photography, logo design, or the running costs of your domain, hosting or other services.
Quotes are valid for 30 days.
2. Payments
- Deposit: 50% of the quote, due before I book your start date.
- Final payment: the remaining 50%, due once you've approved the finished site and before it goes live on your domain.
- Extras added later: quoted and invoiced separately.
- Invoices are due within 7 days. You can pay by bank transfer or card.
- Hourly work outside a quote or care plan is $95 an hour, billed in 15-minute blocks, and always agreed with you first.
Prices are in Australian dollars and include GST if it applies.
3. Your content and the timeline
I'll send you a checklist of what I need, such as your logo, photos, services, areas and contact details, with a date to have it ready (usually 7 days). The build timeline in your quote starts once your deposit and your content have both arrived.
If your content is more than 30 days late, I may pause the project and fit you back in when my schedule allows. If it's more than 90 days late, I may need to re-quote.
4. Changes
Two rounds of changes are included: one on the homepage design and one on the finished site. A round is one list of feedback sent together, within 5 business days of me sending the preview. Extra rounds, or changes to something you've already approved, are charged at the hourly rate, and I'll tell you the cost first.
5. Ownership
Once the project is paid in full, the website's design, files and content are yours. Your domain is registered in your name from day one. I keep the right to reuse my general know-how and any common building blocks that aren't specific to your business, and the tools and services built into your site (like a booking service) stay under their own licences.
Until you've paid in full, I may keep the site on a preview link rather than your live domain.
6. Your materials
You confirm you have the right to use the photos, logos, text and other materials you give me, and that they don't break anyone else's rights or the law. You're responsible for what your website says about your business, like prices, licences and claims.
7. Other services
Your website may use services run by other companies, such as your domain registrar, hosting, booking, shop, email or payment providers. They have their own terms and fees, which you pay directly unless they're included in your care plan. I'm not responsible for their outages, price changes or policies, but I'll help you sort out problems where I can.
8. Monthly care
- Essentials ($49 a month): hosting, security and software updates, backups, fixing anything that breaks, and up to 30 minutes of edits a month.
- Plus ($99 a month): everything in Essentials, up to 1 hour of edits a month, a quarterly check-in on how the site is doing, and help keeping your Google Business Profile up to date.
- Edits are updates to existing content, like photos, prices, hours or text. Unused time doesn't roll over. New pages, new features and redesigns are quoted separately.
- Billing: monthly in advance. There's no lock-in: cancel any time with 30 days' notice, and I'll hand over your hosting, files and logins.
- Price changes: I'll give you at least 30 days' notice of any change to your care price.
Without monthly care, I set up hosting in your name, hand over every file and login at launch, and any later changes are quoted at the hourly rate.
9. Showing my work
I may show your website in my portfolio and on social media once it's live. Just tell me if you'd rather I didn't.
10. If the project stops
- If you cancel: the deposit covers the work done so far and isn't refundable, unless I haven't started yet. If the work done is worth more than the deposit, I'll invoice the difference at the hourly rate, up to the full quote. You'll get the work that's been paid for.
- If I can't finish: I'll refund any payment for work I haven't done and hand over everything completed so far.
- If you go quiet: if I don't hear from you for 60 days during a project, I'll treat it as cancelled after letting you know in writing.
11. My promise, and its limits
I'll do the work with care and skill, and if something I built doesn't work as described in the quote within 30 days of launch, I'll fix it free of charge. Nothing in these terms takes away your rights under the Australian Consumer Law.
As far as the law allows, I'm not responsible for indirect losses like lost sales or profits, and my total responsibility for any job is limited to what you paid me for it. No one can guarantee Google rankings, and I don't.
12. Privacy
I look after your information as set out in my privacy policy. If your website collects personal details from your customers, like a contact or booking form, it'll need its own privacy policy, and I'll add a plain-English one for you.
13. The fine print
These terms are governed by the laws of Victoria, Australia. If we disagree about something, we'll talk it through first and try in good faith to sort it out before anything else. I may update these terms from time to time; the version in place when you accepted your quote applies to that project.
